IMPORTANT INFORMATION

Social, Community, Home Care and Disability Services Industry Award
Unlike other sectors, the minimum wages, loadings and penalty rates in this award WERE NOT transitioned from the date services transitioned to Modern Awards. Award terms such as hours of work, allowances, overtime, meal breaks etc applied from the transitional dates (1 January 2010 for constitutional corporations or 1 February 2011 for non constitutional corporations).
 
Minimum wages, loadings and penalty rates are scheduled to transition to Modern Award rates from 1 February 2012.

Please read the background information before implementing these pay rates.

IMPORTANT CHANGES

From 1 January 2010 NSW referred its industrial relations powers to the Commonwealth. All employees in NSW, except those in the local government and the state public sector, are covered by the Fair Work Act, the National Employment Standards and, following a 12 month transition period for non-constitutional corporations, the Modern Awards.

During the transition period, the state awards that currently apply to non-constitutional corporation employees will be known as Division 2B State Awards.

IMPORTANT CHANGES

With the introduction of WorkChoices on 27 March 2006, constitutional corporations in NSW became part of the federal industrial relations system, and the terms and conditions of the state awards were preserved as a NAPSA (Notional Agreement Preserving a State Award). 

From 1 January 2010, constitutional corporations are covered by the Fair Work Act, the National Employment Standards and the Modern Awards, which specify minimum term and conditions of employment./ 

These NAPSA's have legally expired and are provided for reference only.

IMPORTANT CHANGES

Under the transitional arrangements for the introduction of modern awards, special circumstances apply for the implementation of pay increases for employees previously employed under the Miscellaneous Workers Kindergarten and Child Care Centres (State) NAPSA.  The arrangements also apply to new employees who would have been employed under that NAPSA, were it not for the introduction of modern award.

Employers must continue to pay no less than the minimum wage in the transitional instrument, (ie. the NAPSA) and must also apply any increases awarded to the modern award minimum pay rates from an annual wage review. This arrangement is in place until 1 July 2014.

When determining pay rates for employees under the Children's Services Award 2010, you must refer to both the modern award pay rates for that award, and to these transitional NAPSA pay rates. Whichever is the higher relevant rate from either award MUST be paid.
